Such is the object lesson from the “Sergeant” Bowe Bergdahl scandal – in which the administration of U.S. President Barack Obama acted without congressional authorization to release five senior Taliban commanders from indefinite detainment in Guantanamo Bay, Cuba in exchange for Bergdahl’s release.

Bergdahl, for those of you unfamiliar with his story, was a deserter.

In fact he left his unit days after emailing his parents and informing them he was “ashamed to be an American.” While it’s hard to argue that sentiment these days – and impossible to rationalize the ongoing American military intervention in Afghanistan – the fact remains Bergdahl demonstrated cowardice in the field.

If he felt that way (which again, we’re not knocking), he shouldn’t have enlisted in the first place …

But Bergdahl did enlist. And then walked off his patrol on June 30, 2009, according to an exhaustive 2010 Pentagon report – leaving a note behind declaring his intention to renounce his American citizenship.

“The system is wrong,” Bergdahl wrote his parents shortly before deserting. “I am ashamed to be an american. And the title of US soldier is just the lie of fools…I am sorry for everything here. These people need help, yet what they get is the most conceited country in the world telling them that they are nothing and that they are stupid, that they have no idea how to live. We don’t even care when we hear each other talk about running their children down in the dirt streets with our armored trucks… We make fun of them in front of their faces, and laugh at them for not understanding we are insulting them…I am sorry for everything. The horror that is america is disgusting.”

Bergdahl should have been left to fend for himself. And dishonorably discharged. Instead he was promoted in absentia from private to sergeant.

Yeah … and this is the guy Obama wanted home so bad he was willing to give back five senior Taliban leaders ? All of whom were declared by a Guantanamo task force to be “high” risks to America and its allies?

Wow …

Mullah Mohammad Fazl is no Bowe Bergdahl. He was the Taliban’s army chief of staff. Abdul Haq Wasiq is no Bowe Bergdahl, either. He was the Taliban’s deputy intelligence minister – and trainer of pre 9-11 al-Qaeda operatives. Mohammed Nabi, Khairullah Khairkhwa and Mullah Norullah Noori are not disillusioned deserters, either – they are all hard core Taliban leaders with deep ties to al-Qaeda.

And they’re all back in the wild.

So yeah … Obama just released five of the world’s most dangerous people so he could retrieve one ex-deserter.

And he’s proud of it, too …

“I make no apologies for making sure we get a young man back to his parents,” Obama said, calling the controversy surrounding the deal “whipped up” by Washington, D.C.

Mmmmm-kay …

The upside for Obama and his fellow warmongers? We’re sure these five Taliban leaders will be hard at work plotting retribution against America for its occupation of their country over the last thirteen years – which means they will attack us again, and then we’ll spend trillions of dollars on yet another invasion.

Which is what our government wants  to happen …

Why else would it make a deal like this?

Bush released over 600 detainees. Did you see a sharp increase in kidnappings after that? The Taliban have always been interested in kidnapping. That is not new. Moreover, we didn’t negotiate with terrorists. The Taliban are not on an terror watch list. Wish people would learn to read before they write shit articles like this.

Even if he was a deserter, when do we leave an American POW behind? When do we presume guilt and decide that his punishment should be being held captive/executed by the Taliban. Bergdahl spent a hell of a lot more time in uniform than 99% of the people who read this site and 100% of the people who write this shit.

The Bush administration, for its part, did not seek a declaration of war and labeled Taliban troops as supporters of terrorists rather than soldiers. It thus defined them as outside the protections of the Geneva Convention and the due process of law. This position was later overruled by the U.S. Supreme Court in 2008, following other decisions that overturned some US positions.

You might want to read the law and the US Supreme Court opinions. The Geneva Convention applied to them as if they were POWs. Bush lost that argument then. You aren’t going to win it now.

He had left base once before and come back. His unit did not report it. To be a deserter you have to have the intent not to return. He actually asked his commander if he went off base, could he take his weapon and his NV goggles and was told no. No one has ever established that he wasn’t going to come back like he did the first time.

You’ve got a lot of faith in a Rolling Stone story. Regardless of his intent, he went UA when he left the compound. I was in SWA when this went down, I saw the original “DUSTWUN” reports and then suffered the stupidity of the “personnel asset inventories” that we conducted to insure no one else was missing. You don’t unintentionally walk off of a COP or FOB. After this event security was tightened up theater wide.

A DUSTWUN (DUty STatus and Whereabouts UNknown) is the report that officially designated him as missing.

Between 2007 and 2009, President George W. Bush released 520 detainees from the facility at Guantanamo Bay – at least that’s how many are officially recorded. One of those detainees was Abu Sufian bin Qumu, who is a suspect in the Benghazi embassy attack.

The strangest part of this story is that despite official White House documents and news articles detailing Bush’s actions, people continue to deny that he has negotiated with terrorists. Apparently his negotiations with Iraqi insurgents, Iran and North Korea never made it into the Republican history books.

It is equally true that we’ve killed many of those who had been released earlier on the battlefields of Iraq and Afghanistan.

There is a treasure trove of tweeters doing the same, but those are mostly Fox News viewers who lap up whatever propaganda/chain email/Facebook page comes their way.

TBH, I think the whole thing is somewhat fishy, but I reserve judgement until I know more. What I do know is that there is a shitton of hate and hypocrisy going around that absolutely reeks of desperate politicizing.

If Bowe is a deserter let him be charged and punished as such. I don’t like the idea of letting 5 potentially dangerous people go but it isn’t unprecedented to do exchanges, whether with prisoners or something else.

What I don’t care for are the fucktards who went from “praying for him to be brought back to us” to “that traitorous deserter deserves to be shot” in such a short period of time.

The military weapons alone are astounding, we are arming our enemies, we are arming Al Qaeda. Turning NASA into a muslim outreach center when they can barely manage to build a two story building. The U.S. now supports the guys who throw acid in girls faces, stones and beats and murders women, and now they have five top AQ commanders, who are free to move about Qatar and live in luxury, while 66,000 central American women and children are creating a refugee crisis in Texas. I’m somewhat OK with the general idea that America will go to great lengths to safely bring back our own–even knuckleheads and doofuses who walked away.

I’m less comfortable with trading five high level detainees who will most assuredly be free, and highly motivated, to return to their terrorist ways.

I’m really uncomfortable with orchestrating a White House photo-op and press conference, complete with the guy’s parents, in a way that makes this swap seem like a magnanimous accomplishment of diplomacy and humanitarianism. And Susan Rice says he served “honorably and with distinction”. Seriously? Not to mention the curious timing that suggests this was a bald-faced attempt to deflect attention from the VA scandal.

As the actual FACTS start coming out about Bowe Bergdahl, here is what we know:

1. Bergdahl had left his base without permissions on at least one prior occasion, and had come back! This is according to a report in the Army Times. In fact, his fellow soldiers failed to report it at the time. The implications of this are huge. It means that it would be impossible to prove desertion under UCMJ Article 85, because you cannot prove he intended to leave permanently. Specifically, that article states:

(a) Any member of the armed forces whoâ??

(1) without authority goes or remains absent from his unit, organization, or place of duty with intent to remain away therefrom permanently;

(2) quits his unit, organization, or place of duty with intent to avoid hazardous duty or to shirk important service; or

(3) without being regularly separated from one of the armed
forces enlists or accepts an appointment in the same or another on of
the armed forces without fully disclosing the fact that he has not been
regularly separated, or enters any foreign armed service except when
authorized by the United States; is guilty of desertion.

The only two provisions that remotely could be applicable to Bowe
Bergdahl are subsections (1) and (2). The first one is eliminated by the
fact that he had done this before. Given that he returned on the prior
occasion, it would be extremely difficult to prove an intent to “remain
away….permanently.” The second subsection is also difficult to prove
if he left his base at night, when he was not otherwise on duty. So, as a
consequence, you can pretty much rule out Bergdahl being charged with
“desertion.” At worst, he can be charged under Article 86: Absence Without Leave.
That is a far less serious charge, and “time served” as a POW of the
Haqqani network would probably be deemed sufficient punishment. Which,
incidentally, would also considered an extenuating circumstance under
that article.

UPDATE: The 35 page classified Army report (as reported to the New York Times)
that was compiled 2 months after Bergdahl disappeared, concluded that
he had left his unit twice, not once. And the Army blamed lax security
practices and a lack of discipline. Moreover, the supposed letter he
left confessing to everything was not mentioned in the report at all.

2. According to the now famous article by Michael Hastings about Bergdahl,
his unit was basically a bunch of undisciplined fuck ups who went out
on patrol without helmets, lost weapons, totally lacked morale and
respect for military authority, etc. At least two commanders were
actually demoted! So, you have to take with a grain of salt the
accusations being made against Bergdahl by these people. Especially now
that we know they failed to report Bergdahl left the base without
permission on a prior occasion, and are still telling the media that he
is a “deserter” when they know damn well that’s not true.

3. The New York Times has also reported
that it is almost impossible to attribute the losses the unit suffered
to Bergdahl, or looking for Bergdahl. Given the lack of unit discipline,
etc. One wonders whether Bergdahl is being scapegoated by these people,
who were drummed up by GOP political operatives. You don’t want to
minimize the pain of the families of the lost soldiers. But, frankly,
there is a tremendous amount of misinformation being pushed. And, a lot
of speculation. It’s just an unprovable allegation.

4. And, finally, Bergdahl’s apparent heroism while in captivity has been almost completely ignored and glossed over. The Daily Beast originally reported
that Bergdahl lulled his captors into believing he was sympathetic to
them, and when they let their guard down he escaped for 3 days. When
they finally found him in a hand-dug trench he covered with leaves, he
was nearly naked an exhausted. Yet, it took 5 Taliban to subdue him as
he fought back trying to avoid being recaptured.

Just last night, we found out that he escaped not once, but twice! Because of this, his captors kept moving him around and kept him under tight wraps. This made it exceedingly difficult and risky to attempt a rescue mission.

And, finally, the infamous “ashamed to be an American” e-mails that
numbnuts like Sarah Palin keep using to attacking Bergdahl, were
actually quite patriotic in context. He was complaining about the low
caliber of person he had to suffer through in his unit, and how crappily
they treated the Afghans (In one case, he said they indifferently ran
over a child with a truck!). He was ashamed of the way the military
operated there.

He was not expressing a desire to join the Taliban. He felt sympathy
for the Afghan civilians who were being mistreated and abused by both
sides. (These e-mails were reported in Michael Hastings’ profile
pieces).

When all is said and done, and Bergdahl is allowed to give his side
of the story, the Republicans and Conservatives who were attacking him
are going to regret it.

One other point on this that I didn’t address in my comment. All of
the crazy rightwingers who are suggesting that Bergdahl be executed for
desertion are even more batshit crazy than it might seem at first. Even
if he WAS guilty of desertion (a proposition which is extremely doubtful
at this point), only one U.S. service member has been executed for the
offense since the Civil War! That man was Pvt. Eddie Slovik during World War II.
In his case, he signed a confession — over the objections of his
commanders! – and was defiant of military authority. Eventually, Dwight
Eisenhower authorized his execution to set an example.

Moreover, in 1974 President Gerald Ford signed a conditional amnesty for Vietnam War deserters, if they agreed to two years of public service in some other capacity.

And, finally, the lone soldier convicted in connection with the My
Lai massacre of Civillian Vietnamese villagers during Vietnam — Lt.
William Calley — had his sentence reduced to House arrest and then finally commuted to time served by President Nixon after 3 years.

And, to make this even more pertinent, Staff Sgt. Robert Bales, who
plead guilty to murdering 16 Afghan Civilians in their homes, was sentenced to life in prison without possibility of parole.

In other words, the batshit rightwingers want to impose a sentence on
Bowe Bergdahl that is a) unsupported by any evidence; b) hasn’t been
imposed on a US Soldier in 70 years, and only once in 140 years; and c)
more harsh than what was imposed on convicted mass murderers of
civilians.

Two, under the Geneva Convention, they could not have been housed forever, but would have been released at the latest in 2016 when the War in Afghanistan was over because they were POWs. You do realize that the Geneva Convention absolutely applies to Gitmo….might want to read some US law on that, particularly those opinions from the US Supreme Court who concluded otherwise. Bush lost that argument years ago. Also…we ratified the entire convention. With did not ratify Protocols I and II, though they were in fact signed, and in fact, we are determined by the international community to be bound by them despite the lack of ratification due to the fact that we signed them. And those Protocols only applied to victims of the violence. Not the combatants.

There are plenty of folks who have nothing to do with the Taliban. Agreed. These 5 people however.

Bergdahl sent emails to his father explaining he wanted to renounce his American citizenship, left a note for his unit to read, wandered off post, sought out the Taliban and in the days, weeks and month after his desertion attacks on US troops in the area became more targeted and precise. That my friends is no POW… that is a traitor. If Bergdahl wasn’t providing the enemy with important information, his head would have been sawed off and broadcast on Durka Durka Television in HD. Any of you sitting around “waiting for the story to unfold” is clearly only waiting for the narrative to written, edited and rewritten by Barry and Co.

And your source of this? The people in his unit? Doubtful. They were a bunch of fuck-ups who were interesting in covering their own asses. His unit would go on patrols in baseball hats and lose their weapons. I just read all the emails he wrote is father and there was NOTHING in there about renouncing his citizenship. He spoke to his commander before he left the base and his commander told him he could not take his NV goggles or his weapon. He tried to escape twice as well.

From 2012–which by the way, is when Congress knew they were working on a deal to release 5 detainees in exchange for Bergdahl.

The discipline problems that had plagued Bowe’s unit back home only got worse when immersed in the fog of war. From the start, everything seemed to go wrong. In April, Lt. Fancey was removed from his post for clashing with a superior officer. He was replaced by Sgt. 1st Class Larry Hein, who had never held such a command – a move that left the remote outpost with no officers. According to four soldiers in the battalion, the removal of Fancey was quickly followed by a collapse in unit morale and an almost complete breakdown of authority.

The unruly situation was captured by Sean Smith, a British documentary filmmaker with The Guardian who spent a month embedded with Bowe’s unit. His footage shows a bunch of soldiers who no longer give a shit: breaking even the most basic rules of combat, like wearing baseball caps on patrol instead of helmets. In footage from a raid on a family compound, an old Afghan woman screams at the unit, “Look at these cruel people!” One soldier bitches about what he sees as the cowardice of the Afghan villagers he is supposed to be protecting: “They say like, the Taliban comes down and aggravated­ their town and harasses them… Why don’t you kill those motherfuckers? All of you have AKs. If someone is going into my hometown, I know my town wouldn’t stand for that shit. I’d be like, ‘Fuck you, you’re dead.'” Another soldier laments, “These people just want to be left alone.” A third agrees: “They got dicked with by the Russians for 17 years, and now we’re here.”

Laughable considering I haven’t watched a frame of FOX news since I cancelled cable almost 9 months ago. There’s a huge difference between “bunch of soldiers who no longer give a shit” and a guy that walks off post and seeks out the enemy. Regarding Sean Smith, have we learned nothing from the likes of Micheal Moore and Al Gore, the story is made up in the editing suite.

None of your business but: I spent three years in the US Army. 67-70. One year in Vietnam (68) I was shot at but with an Engineer MOS didn’t get to shoot back. We had infantry support on job sights when necessary I have seen men shot and, blown up.. After Vietnam I was assigned to Fitzsimons Hosp. in Denver where I saw the results of booby traps and the like. I am not a Lindsey Graham chicken hawk but I do know a coward when I see one. If I could have filled out my own incident reports maybe I would have been a hero like Kerry. NOT.

There was a soldier in Vietnam who tried to defect but ended up in a prison camp. We brought him home and then courtmartialed him. It’s standard procedure. You can’t just leave your soldiers in enemy hands.

Here is the point:

1. He was and is a US Army soldier. He served his country. He wore the uniform.
2. He was in the possession of the enemy.
3. We don’t leave our men behind. Period. We have made POW exchanges in every war since the beginning of our country’s existence.
4. We don’t leave the Taliban to determine his guilt or innocence on whether his unauthorized leave was something more.
5. We don’t let the Taliban enforce our laws and carry out our punishments, regardless of the crime.
6. He is presumed innocent.
7. He will have his day in court if it is determined there is sufficient evidence that he deserted or collaborated or whether he was suffering from PTSD or had a mental breakdown.
8. Not a damn person on this site knows the truth about those details and yet not a goddamned one of you wants to give the man the presumption of innocence.
9. Like it or not, he is one of us. Born and raised one of us. I am damn glad he is back in American custody because unlike a lot of you one here, I support every man or woman who has served his country. And if he committed a crime he will be made to answer for it.
10. If it were your brother, sister, son, daughter, cousin, father or mother, you too would do every thing in your power to have the government free them.

The WH claims AWOL Private Bergdahl’s health was in peril. Shoot, if he was stateside, it would take him 5 months to see a doctor at Dorn’s VA Hospital in Rep Joe Wilson’s district.

Why not trade the the illegal immigrants being released at a Texas Greyhound bus station by Immigration and Customs Enforcement for our Marine held hostage by Mexico since May 2013? Let him take the Greyhound back to Texas?

The five Al-Qaeda generals were most likely released with help from Graham and McCain to whip up morale of rebels in Syria to finish the takeover of Assad.

BTW…Syria still has chemical weapons. Obama and Kerry are mad and will not tolerate these weapons in Syria…well, maybe not.

Couple of observations here:

1. Has FITS ever served in the armed forces…much less served in war time combat in hostile areas as Bergdhal did?

2. Why does FITS not mention Israel swapping 1000 Islamic militants for 1 soldier a couple years back?

3. Bergdhal was not wrong is his assessment of America’s actions vis a vis Iraq and the way the war was being managed in Afghanistan at the time he wrote those emails. He’s also not wrong on the US Military’s entrenched system of poor mid-level leadership.

4. So you all are saying that we should just leave our captive, active duty American personnel behind to rot…despite these same GOP douche bags calling for his release just months prior…even to the point of prisoner exchanges?

5. Lastly, even Fox News’ own Charles Krauthammer has defended the prisoner swap…and he’s meant to be the grande gentleman conservative scholar on a network that is otherwise composed of nimcumpoops and nitwits.

This was a bad idea – whether fits had been a Navy SEAL or not, weather another country thought it was a good idea or not. His “capture” has never been corroborated, only his leaving and likely desertion. Obama admittedly broke the law – with no exceptions, and notably called the guy a POW – the DoD due to the circumstances of his volitional leaving of the military never catagorized him as a POW or even MIA. You cite Krauthmauer, how about even Fienstien saying she was disappointed? FWIW, I’m a huge dem, double militray brat and think Bush’s presidency will mark the turning point in American greatness – BUT this was a poorly thought out bone headed, strategically militarily, political worthless and likely detrimental move. How many British soldiers would the colonist have traded for Benidict Arnold’s release – hopefully less than five. This was just stupid.

The reason Mike and I don’t comment on the “deep post network” is we were with MKUltra (the project, not the cannabis strain) at one time, having discovered each other on the DPN – agreed it wouldn’t be prudent to make further contacts, to help maintain our cover.

First of all, no one really knows what happened (unless you listen to Fox News). If Bergdahl is a deserter, then he will be dealt with accordingly. Secondly, the 5 Gitmo detainees would have been released at the end of the year anyway. Finally, let’s be realistic– they (Iraqi, Afghani, etc.) all hate our government, five more in the fight is like pissing in the ocean and expecting the tide to change.

Private Bergdahl is coming home with a 155 ml Howitzer sized asshole only to be put up on charges for desertion. He would have been better off biting off the dick of his last musloid rapist. That way he would be assured they would not have beheaded him, just hanged him with some rope. Bergdahl will be in prison soon enough. He will be someones bitch in Leavenworth. Too bad, really. We lost many good soldiers looking for him and could have trained many more with the money we spent picking him up. Next time, deserters will just be shot in the field.

Two of the 6 were involved in the Afghan elections protecting people. Unless they thought Bergdahl was showing up to vote, their deaths had nothing to do with Bergdahl. The Army and the Pentagon have both said there is no evidence to support the claim about the 6, but I am sure you know more than they do.

Retired Gen. Stanley McChrystal on Wednesday urged Army Sgt. Bowe Bergdahl’s critics not to “judge” him until all the facts are in and sharply defended the extensive and risky search efforts that claimed the lives of some of his fellow soldiers.

“We did a huge number of operations to try to stop the Taliban from being able to move him across the border into Pakistan,” McChrystal told Yahoo News in an exclusive interview. “And we made a great effort and put a lot of people at risk in doing that, but that’s what you should do. That’s what soldiers do for each other.”

Asked whether he would have made the same prisoner swap, McChrystal replied: “We don’t leave Americans behind. That’s unequivocal.”

In 2011, Israel freed 1,027 Palestinian prisoners in exchange for Sgt. Gilad Shalit. Bergdahl was exchanged for 5 Taliban prisoners

I guess because Bergdahl was a private…. or maybe because they knew the Republicans don’t put a high value on our soldiers, and had to act fast before they got wind of it.
